1. Acceptance of Terms
By creating an account or using Delete Upon Death ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
You must be at least 18 years old to use this Service. By using it, you represent that you are at least 18 years of age.
2. Service Description
Delete Upon Death provides:
- Zero-knowledge encrypted file storage
- A "dead man's switch" system that monitors for user activity
- Automatic, permanent deletion of all data upon confirmed death or prolonged inactivity
- Optional add-ons including hardware security keys, death registry monitoring, and geographic redundancy
The Service is designed so that we cannot access the contents of your files. All encryption occurs on your device before data reaches our servers.
3. Accounts
Account Creation: You create an account by choosing a username and password. We do not store your username or password — only cryptographic hashes derived from them.
Account Security: You are solely responsible for maintaining the security of your password. We recommend using a strong, unique passphrase of at least 16 characters.
One Account Per Person: Each account is intended for a single individual. Do not share your account credentials.
4. Payment
One-Time Payment: The Service is provided for a one-time fee. This covers your vault for your lifetime.
No Refunds: Due to the nature of the Service (immediate access to encrypted storage), all sales are final. We do not offer refunds except as required by applicable law.
Add-Ons: Optional add-ons are also one-time purchases unless otherwise specified.
Anonymous Payment: We offer anonymous payment options (cryptocurrency, prepaid cards, cash by mail). We do not link payment information to vault contents.
5. Your Content
Ownership: You retain all ownership rights to the content you store in your vault.
We Cannot Access It: Due to zero-knowledge encryption, we cannot view, analyze, or access the contents of your files. We store only encrypted data that is meaningless without your password.
Your Responsibility: You are solely responsible for the content you store. You represent that you have the legal right to store such content and that it does not violate applicable laws.
6. Prohibited Uses
While we cannot monitor your encrypted content, you agree not to use the Service to store:
- Child sexual abuse material (CSAM)
- Content that violates others' intellectual property rights
- Malware or tools designed to harm computer systems
- Content in furtherance of terrorism or violent extremism
If we receive a valid legal order with sufficient evidence that an account is being used for prohibited purposes, we may delete the account (though we cannot access or verify the encrypted contents ourselves).
7. Death & Deletion
This is the core function of the Service:
- Check-Ins: You must periodically "check in" to confirm you are alive. The default interval is 14 days, configurable up to 90 days.
- Missed Check-Ins: If you miss check-ins, we send reminders. After multiple missed check-ins, we initiate death investigation procedures.
- Death Detection: Death may be confirmed through: (1) multiple missed check-ins, (2) reports from your designated trusted contacts, (3) death registry monitoring (if enabled).
- Grace Period: Before deletion, there is a grace period (default 30 days) during which you can check in to cancel the deletion.
- Permanent Deletion: Once confirmed and the grace period expires, all your data is permanently and irreversibly deleted.
Deletion is Irreversible
Once deletion occurs, there is no recovery. This is by design. Make sure your check-in interval and trusted contacts are configured appropriately.
8. No Password Recovery
Critical: We cannot recover your password or your data if you forget your password. This is not a limitation — it's a feature. Zero-knowledge architecture means we never have access to your encryption keys.
If you lose your password:
- We cannot reset it
- We cannot decrypt your files
- Your data is permanently inaccessible
- You will need to create a new account (previous data is lost)
We strongly recommend storing your password physically in a physically secure place; e.g., a safe deposit box.
9. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any data loss, including data deleted through the normal operation of the dead man's switch
- We are not liable for unauthorized access to your account resulting from your failure to protect your password
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid for the Service
Some jurisdictions do not allow limitation of certain warranties or liabilities, so some of the above may not apply to you.
10. Termination
By You: You may delete your account at any time from your vault settings. Deletion is immediate and permanent.
By Us: We may terminate accounts that violate these Terms. Given our zero-knowledge architecture, this would typically only occur in response to valid legal process with evidence of prohibited use.
Effect of Termination: Upon termination, all your data is permanently deleted. There is no data export after account deletion.
11. Changes to Terms
We may modify these Terms from time to time. When we do:
- We will update the "Last updated" date
- For material changes, we will notify you via your notification address (if on file) or prominent notice on our website
- Continued use of the Service after changes constitutes acceptance
